If a man is mentally abused and able to plot the death of his abuser (e.g. his wife), should he get...?

...a lenient sentence based on the claim (with or without any documented evidence) that he was abused?

However, add to this another question - if he was capable of plotting and executing his abuser's death, couldn't he have also been mentally strong enough to plot & execute his own escape from his abuser?

Now you may consider, "ahh, but men tend not to have many realistic escape routes - had he been an abused woman he could turn to one of several avenues for (her) escape, but this guy didn't.. and if he tried to take the kids, he'd likely be hunted down and accused of kidnapping." - but for sake of argument, let's pretend this guy had plenty of options open to him...

All he had to was make a phone call to one of several 'abused mens homes' or 'domestic violence support agencies' - he could have phoned the police and been taken seriously and he could have acquired a new identity for himself and his children.

Your "theoretical" scenario occludes one person: HE.

The "plotter" does not seem impaired to me, to "plan" all details; it seems to me pretty lucid and - if I may - pretty revengeful. Why not just divorce and stop the abuse?

He watches you and me. He knows the difference between "killing" and "murdering"; the first one (accidentally or in defense), provided within a "city of refuge" where the killer could live without being killed by the victim's family for a certain time, free, but the second one was handed down a death sentence, and so stated it in His commandments to the Hebrews.

You may do away with this "hypothetical" plot - because He may 'release' her from His palm ("no two birds drop to the ground without The Father knowing it") - but I believe in the end you will pay, either here or on the other side, that is IF you believe.

If you don't believe, I think it would be hard to imagine WHAT can someone crossing on the other side expects. In any case, like Visa, it's pay now or later.
